General Terms and Conditions

1. Introduction
   1. The online shop vakuum-profi.ch is operated by Rigaflex AG. Rigaflex.ch is the name of the managed web shop.
2. Scope
   1. These GTC apply to all products and services offered by Rigaflex AG. All sales, deliveries, and services are carried out in accordance with the GTCs of Rigaflex AG. If the customer establishes conditions that deviate from the GTCs, then these must be reviewed and agreed to by Rigaflex AG.
3. Product information
   1. Of course, Rigaflex AG always strives to publish all information regarding products and services in a timely and correct manner. Individual pieces of information are published by different manufacturers, then reviewed and adopted by Rigaflex AG. In some cases, we must rely on the information provided by the manufacturers as being correct. Therefore, Rigaflex AG accepts no guarantee for any of the information on products and services published in the web shop.
4. Price information
   1. All prices shown in the web shop are in CHF and include VAT. For business customers, prices are exclusive of VAT.
5. Conclusion of contract and cancellation
   1. Products, services, and prices published on vakuum-profi.ch are considered offers.
   2. The contract is concluded as soon as the customer places their order via the online shop vakuum-profi.ch. The customer will then receive an automatic order confirmation via email to the email address they have provided. This order confirmation serves to inform the customer that their order was received, and that a contract has come about. It is not considered a commitment that the ordered product can be delivered effectively.
   3. Orders are binding, and the customer is obligated to accept the ordered goods and services. Cancellations or changes may be made only by Rigaflex AG.
   4. The offer is always subject to the conditions precedent that the deliveries and services can be delivered, and that the pricing information provided is correct. If one of these conditions is not met, the contract will be dissolved. If the product was already received by the customer, ownership shall be returned automatically to Rigaflex AG. Rigaflex AG must repay the amount to the customer. If the product has not yet been delivered to the customer, the customer is not obligated to accept it. Rigaflex AG is not obligated to carry out any replacement delivery. If the customer does not accept the ordered products, despite their acceptance obligation, Rigaflex AG may dissolve the contract. Any resulting costs (handling costs) may be invoiced. If Rigaflex AG is unable to complete its deliveries, the customer has the right to withdraw from the agreement (right of withdrawal). If the contract is canceled due to non-delivery by Rigaflex AG, any amounts already paid out by the customer will be reimbursed.
   5. Products delivered to the customer shall remain the property of Rigaflex AG until they are paid in full.
6. Availability and delivery
   1. Rigaflex AG only delivers to customers within Switzerland via its online store, to the curb. Rigaflex AG does not offer delivery inside the building. Delivery times for the products available in the web shop are displayed with the product data. We differentiate between the following availabilities:
      • Green = Delivery within 2-3 days
      • Yellow = Only a few items left in stock, delivery within 2-3 days
      • Red = Currently unavailable
   2. Likewise, delivery delays may occur due to delivery difficulties or stock shortages. If production of an ordered product has been discontinued, it may not be possible to complete the delivery, and the contract will be dissolved automatically.
      The customer is obligated to check delivered products promptly after receipt to ensure they are correct and complete.
      Any defects or damages must be reported promptly after they are discovered, and at the latest 5 days after receiving the delivery. Rigaflex AG accepts no liability for damage in transit.
7. Shipping costs
   1. We deliver free of charge above an order value of CHF 50. Shipping costs are charged for order values up to CHF 49.99. These are CHF 5.90 for up to 20 kg and CHF 11.90 for 20.1 kg to 35 kg.
8. Payment conditions
   1. The customer undertakes to use one of the available payment methods. The following payment options are available:
      • VISA, Mastercard, and Twint.
9. Payment obligation
   1. If the customer does not comply with their payment obligation, meaning that the customer pays the amount owed too late, or does not pay or does not pay in full, Rigaflex AG will immediately halt all deliveries. Rigaflex AG reserves the right to withdraw from the agreement at any time and without grounds.
   2. If the customer does not react to a request for payment by Rigaflex AG, the contract will be dissolved automatically 10 days after the last request for payment is made. Rigaflex AG will charge a fee of CHF 20 with the 3rd warning. After the 3rd warning, any amounts that have not been paid will be reported to the collection agency and pursued by it.
10. Warranty
    1. The warranty period for all products offered in the online store is specified in the product details. A longer warranty term may be granted for individual products. This warranty term is granted by the manufacturer. If the manufacturer does not grant a specific warranty term, then the statutory warranty term valid in Europe for 2 years applies.
    2.  Warranty coverage is granted only if there are no grounds for exclusion. Grounds for exclusion include damages due to falling, impacts or moisture, natural wear and tear, malfunction due to independent modifications to or interventions in the product. All wear parts are excluded from the warranty.
11. Products may be exchanged or returned within 30 days
    1. In general, products may be exchanged or returned within 30 days from the delivery date, if the products and packaging are in proper condition and are suitable for sale. Report the exchange or return to us in advance, in order to discuss the process.
12. Product returns
    1. If Rigaflex AG approves a product return, this will be carried out at the cost and risk of the customer. All products must be returned in their undamaged original packaging. Returns with products that are not in their original packaging and/or with damaged packaging will not be approved. A description of the problem and a copy of the invoice must be enclosed. Otherwise, Rigaflex AG may deny acceptance.
13. Data error
    1. Rigaflex AG accepts no liability for any data errors in the online shop resulting from slight negligence. Rigaflex AG shall not be liable for accidentally incorrect pricing or product descriptions.
14. Data protection
    1. Rigaflex AG guarantees compliance with the legal provisions of the Swiss Data Protection Act. Customer data will be used only for internal purposes, and not transmitted to third parties. Data is transmitted to third parties only if this is necessary to properly perform services.
15. Applicable law and place of jurisdiction
    1. In case of disputes, only Swiss law shall apply. The place of fulfillment and jurisdiction is Olten SO.
